What is a Geographical Indication?

Geographical Indications provide producers and their associations exclusive rights to use a place-based designation for 10 years, renewable indefinitely. Registering your GI stops others from using the same or similar indication on goods that do not meet your approved standards and geographical conditions, protecting your product’s authenticity and reputation.

A GI is a sign that identifies a good as originating in a specific territory, region or locality, where its quality, reputation or other characteristics are essentially attributable to that origin. It may take the form of geographical or personal names, letters, numerals, symbols, shapes, colours, holographic elements, or any combination of these.

Applications in UAE are handled by Ministry of Economy (MoEc) through Trademark / Geographical Indication Portal. Geographical Indications in UAE are covered under Federal Decree by Law No. (36) of 2021 Concerning Trademarks and the resolution. Keep in mind that applying through the MoEc will give you protection in the UAE only. If you wish to be protected in other countries or regions, you will need to apply through their IP offices.

To apply for a Geographical Indication you must be a UAE citizen or have residence status in the UAE. If you are applying from outside the UAE, a local IP Attorney may apply on your behalf.

Before applying, be careful not to share any confidential information about your idea. This helps protect its novelty, prevents others from copying it, and keeps you ahead in the market. Make sure you have agreements in place to keep your idea private. If you don't, your application might be rejected.

Differences between Geographical Indications, Trademarks and Plant Variety

Geographical Indications, Trademarks and Plant Variety Protection each safeguard different forms of intellectual property in the UAE. Geographical Indications are governed by Federal Decree-Law No. 36 of 2021 on Trademarks and its Executive Regulations. The table below compares their scope, duration and key considerations to help you choose the right protection for your products, brands or new plant cultivars if applicable.
